Student visit refusal of leave to enter with right of appeal

Post by Nouran » Sun Mar 02, 2014 11:11 pm

This is my refusal of leave to enter and I need help what to do

"You have sought leave to enter as a student visitor for 27days . This was granted on visa issued by the British embassy in Abu Dhabi on 25-9-2013 and which was valid until 25-3-2014 . However , you are seeking entry until the 29th march 2014 and this is more than the six months which is allowed.

You have not sought entry under any other provision of the immigration rules.

I therefore refuse you leave to enter . If your leave was conferred by an entry clearance, this will also have the effect of canceling your entry clearance. The cancellation of your leave will be treated for the purposes of the immigration Act 1971 and the nationality , immigration and Asylum Act 2002 as a refusal of leave to enter at a time when you were in possession of a current entry clearance .

When did you try to enter?
Why did you seek to remain beyond the leave granted by your entry clearance?

Where are you now?

Did they notify you that you have an in-country or out-of-country right of appeal? If you have an in-country right of appeal and you appealed, then the appeal may take months; you may remain in the UK even longer than requested! If you have an out-of-country right of appeal, then there's probably no point in appealing.

All these happened yesterday and they give me 10 days

I didn't make an appeal yet and I want to stay to finish my course

What I have to do now???

Is that mean that I cannot enter again uk?

If you have an in-country right of appeal, then appealing may give you more time to finish your course.

Whether or not you will be banned from re-entering for a certain period depends on how they will treat this refusal in the future. A change in circumstances or purpose probably shouldn't affect future applications. However, if they treat this as deception in obtaining your previous entry clearance, then you may be banned for 10 years.

So, it may make sense to also clear this point up in the appeal.

I don't in country appeal or out country
They gave me 10 days for appeal

If I made an appeal and return to my country before the visa expired, I will be banned from entering uk while am applying for visa?

If you can appeal while you are in the UK, then you should be able to remain in the UK until the appeal is decided.

if you appeal from within the UK then you can't leave the UK whilst the appeal is outstanding.

If I didn't make an appeal , and returned home back before the date they set to me and before the expiry of visa

Is this solve the problem ?
Can this affect in applying in my next visa
