Studying on a Fiancee/Proposed Civil Partner Visa - is it Possible?

Post by FredBear » Mon Aug 12, 2019 12:39 pm

I'm hearing conflicting advice about whether it is possible to study on a Fiancee Visa...does anyone have any knowledge or experience with this?
many thanks.

Partner arriving In less than a month and due to start a university course on a fiancée visa with a view to getting married and applying for settlement straight away... but not getting clear advice if this is possible...

Call the university and asked.

Most schools / universities are under very strict rules from the Home Office when it comes to accepting non-EEA students. Their either need to see a Tier 4 visa, visitor student or a residence allowing to stay in the UK (such as EEA family member, ILR...). I don't think a spouse visa would be accepted but see with the university because ultimately its their decision if they accept a student or not.

A 2.5 year spouse visa would be accepted, but unlikely a 6 month Fiance visa would be.

Absolutely. A spouse visa is OK but a fiancee visa is short and looks like a glorified visitor visa. I don't know of any university / school that would accept someone on a fiancee visa.

Also, the fiance visa is granted solely for the purpose of marrying and subsequently applying to remain as a spouse.

On another point following the mention of 'settlement' in the opening post, to clarify and avoid any confusion, 'settlement' relates to ILR (permanent residence free of Immigration control) and your fiancee will only qualify for this once she has completed 5 years (2.5 x 2.5) of residence in the UK as a spouse.

Has your fiancee actually been offered a place at a UK University, as your post suggests :?:
