Hello,

It will be great help if you can answer my questions:

I am currently on a Tier-2 ICT long-term visa working in London. My visa is still valid till 2017 (from 2012 – 5 yr period). My husband holds Tier-2 ICT depended visa but works in India and stays in India.

Can I apply for a switch of my Husbands visa from Tier-2 ICT depended visa to Tier-2 General from India.

Cooling off period under Tier -2 ICT

Hello,

Does cooling off period only means staying out of the country for 12 months ? If I'm still employed with UK company on Tier-2 ICT long term visa but outside UK for 12 months then would this be counted in the cooling off period ?

You don't have to. Your husband can apply to switch to Tier-2 Gen visa from India provided he's gets a genuine sponsor to sponsor him.

Since I'm on Maternity leave and staying out of UK for more than a year, I'm paid the minimum salary as per the rules.

Please confirm if this can be counted in the cooling off period.

This means that you'll continue to be on your UK company's payroll during your maternity leave. In that case, it cannot be counted as part of cool off period.
