Switching from Tier 2 General to dependent

Post by ankitamishra1006 » Fri May 03, 2019 8:00 pm

Hi,

I came to UK as a Tier 2 general migrant but after 3 years I had to resign from my job, now my husband (who was here as a dependent on my visa) has got the sponsorship and is planning to go to India to apply for Tier 2 general visa. I have couple of questions, do I need to go back with him to India to apply for a dependent visa or I can do it while I am in UK, the second question is my employer informed home office about the revocation of the sponsorship and its been around 60 days but I haven't heard anything from the home office so if I stay more than 60 days from the last day of my Job will I and my husband be considered as an over stayer?

Thanks

When does your current visa expire? When did you resign?
do I need to go back with him to India to apply for a dependent visa
No.
or I can do it while I am in UK,
Yes, provided you still have a valid visa.
the second question is my employer informed home office about the revocation of the sponsorship and its been around 60 days but I haven't heard anything from the home office so if I stay more than 60 days from the last day of my Job will I and my husband be considered as an over stayer?

60 days curtailment starts from the date of the HO curtailment letter and NOT from the date employer notifies HO of your employment ending. Hopefully HO have your current address.

I haven't changed my address and its the same address from where I applied for the extension and received my Visa
