Switching to Tier 2 General from Dependant

Hi

My partner is currently in UK on Tier 2 Dependant visa. We are planning on terminating our relationship, but she has already found a company that is willing to sponsor her to get Tier 2 General. Now I know that she needs to go back to the home country to apply for Tier 2 General. The question I have is whether the employer can apply for certificate for her while she is still on Tier 2 Dependant in the country? Or does the dependant visa need to be cancelled first?

They can apply while she is on Tier 2 G dep and in the country. Proper RLMT process will have to have been followed.
