T1G/ILR and Dependants/Family Member Complicated Query

Post by Gudwin » Tue Apr 28, 2015 7:02 pm

Hi all,

I was arrested a month ago with notorious DD (DR10) conviction (unfortunately), so sent T1 extension by the post before the deadline.
The court hearing is scheduled on 10th of July. 10 days ago submitted biometric information.
Yesterday received a letter from HO saying that due to pending trial the decision on my application will be postponed until the court decision.

As far as I understand the general grounds for refusal don't work for T1 G extension, so why the postpone?
Basically, I won't have my passport and current BRP which expires only on 28.10.15, so cannot leave country and have no idea what to do next, if the extension doesn't go through and I am convicted.

So, could somebody please explain to me what's going on and what to expect?

I'm guessing that 345CB(a) may depend on any convictions.

However, there may be a further problem:

Hi Vinny,

I couldn't find 345CB using your link, it's only 245xx sections.
I don't care about 2018, because if I get my T1 extended now I'll be able to apply for ILR in 2017.
But the holdup is confusing, because I never heard about T1 extension being declined due to non-custodial sentence.

P.S. Another confusing bit - well, even somehow I get my T1 declined, it will mean that I won't be able to get T2 for exactly the same reasons, will get properly stigmatized and thrown out of the country? That's a bit harsh, isn't it.
