Hello all,

I went to the UK in 11/2016 with my wife and kids. We extended one time. Our BRP’s expired date are 11/11/2022. To save cost, I and my wife only submitted the ILR form and we got ILR at 18/11/2021. I have some questions and need you advice please.

1/ my kids still legal to stay in the UK until the BRP expired. Or i must to apply ILR for them.
2/ we plan to travel home in the next summer (7/2022) as holiday around one month. Can my kids enter UK again with their current BRP?
3/ according the rule, i can apply citizen 19/11/2022. I intend to apply them with us. However, their BRP is expired that point fews days. Does it impact and home office will reject their form?

What were the categories or basis for the grant of ILRs?

Hello Vinny,

Thank you for reading my case and trying to help me. I am not sure if I understand your question too much. I went to the UK with the tier 2 general (skill worker). And We apply the ILR as the route of 5 years.

Please let me know if I can provide more information. Sorry because I am not familiar with that so may be I did not provide enough information at the initial post.

1. Your kids should be okay until their leave expire.
2. Yes.
3. If they were born in the UK, then they are entitled to register now. Else, they should apply for ILR before their leave expire.

Hello Vinny,

Thanks for your help. I think to avoid the risk, I should apply ILR for them before expired date. However, it will cost me.

I am wondering if that short expired date is broke the overstay rule? I read some thing in the internet and they told about the acceptable 14 days but i am not sure does it work for my case. If you have anything, please help me to advise. Thank you very much.

You need to apply for the children's ILR before their visas expire if the children were born abroad.

There is no shortcut to avoid the cost for ILR for children born abroad.
