Hello Everyone,
If someone can answer my couple of queries please.
I am on Tier 2 visa (Sponsored) and due to renew my visa in Aug 2016. The visa granted to me was for 3 years and after this I can get another 2 years visa. Are there any conditions on what salary should I have to be eligible for the remaining 2 years. As I have read somewhere the salary should be 40,000 or above. Can someone comment on this please.
Secondly my wife just got Indefinite leave to remain ( long residence) I heard I can apply for FLR (M) on the bases of her ILR. I have been told couple of years before that if you are on Tier 2 work permit visa for 2 years and change your visa to FLR (M) you can then apply for ILR. CAn someone confirm this as well.

If you switch to FLR(M), your clock will reset to zero and it is a new 5 year route. Advantage is that you are free to work for any employer.

if you continue on tier 2, at the time of ILR, you will need to be earning over 35k unless your occupation is in shortage occupation.

Thank you for your reply. I am due for ILR next year if I change my category to FLR (M) is that still mean I cant apply for ILR next year as it has been reset.

Correct. If you switch to FLR(M), you will have to be in the visa category for 5 years before you will qualify for ILR. The rules changed in July 2012 from 2 years to 5 years.
If your aim is to get ILR asap, then stay on your Tier 2 visa and meet the requirements.

HI All,

I am thinking to change my category from Tier 2 to FLR M (Partner of settled person). I know there is a rule that you can apply for ILR in 5 years, if you have visa based on partner of settled person. I also read if you applied FLR (M) than all your time reset. Can someone confirm is that true. Is it will ok to change to FLR (M) in August this year and apply for ILR Sept 2016.

Is it will ok to change to FLR (M) in August this year and apply for ILR Sept 2016. Yes, FLR(M) can be applied for at anytime if you and your spouse meet the requirements. If you are reaching 10 years long residency in September 2016, you will be ok to apply as you can use a combination of visa status for this route of ILR so you would not have to wait a further 5 years on FLR(M). You should have mentioned your 10 years eligibility when you started your post as this would have avoided confusion.

since u will be able to apply for ilr on 10 years basis, i would say aply for FLR(M) beore 5 april, and save yourself from medical surcharge being introduced soon.
