Tier 2 - Switching employers

Hello All,

I have been granted my Tier2 (General) on 19 Dec 2017 (switching from Tier 4). and the expiry for my current tier 2 leave is on 24 Dec 2020.

I am planning on changing my employer, as I have been offered another job.

Regarding the start date in the new position; would it be ok to apply for tier 2 extension and to put my starting date as 1 Jan 2021 ? Or should I put the day after my current tier 2 leave immediately (25 Dec 2020) ?

The reason I am asking this, is to avoid paying an extra year of IHS fees for me any my family (given that I will be applying for 2 years extension -not 3-, since I will be eligible for irl then),

Hello All,

I have been granted my Tier 2 (General) switching from Tier 4 with following details:
Start Date on BRP: 19-Dec-2017
Expiry Date on BRP: 24-Dec-2020
Work Start Date on CoS: 11-12-2017
Work End Date on CoS: 10-12-2020
SOC: 2139

I am planning on changing my employer, as I have been offered a job and got assigned an unrestricted CoS with a different SOC from the one I was in.

The new employer has assigned me a CoS with the following details:

Work Start Date on CoS: 25-12-2020
Work End Date on CoS: 24-12-2022
SOC: 2135 Shortage Occupation List

1. Once the new employment visa is approved (if approved), what would be the start date of the visa (BRP)? Would it be the approval date? or the start date of the new job?

2. Would the period between Work End Date on CoS: 10-12-2020 and Expiry Date on BRP: 24-Dec-2020 considered to be an employment gap? if not, can I work for my current employer during it? or should I stop working, and wait for my new CoS Start Date on 25-Dec-2020?

3. If my current employer make me redundant, would that affect the new visa application (depending on its start date)?

1. Usually approval date.

2. There is no employment gap or any such restriction in the tier 2 rules. You can work for your current sponsor until your new visa is issued

Thank you for your prompt reply CR001.

So if the approval date was 1-Nov-2020 (for example), and my CoS start date of new job is 25-Dec-2020:

- in this period, I should keep working for my current employer (or wait for the start the new CoS start date if I get redundant by my current employer). Correct ? Or do you mean that I can work for the new employer once I get the approval regardless of the new CoS start date?
