Tier 2 dependant to Tier 4 main applicant

Hi all, i urgently need your help for answers.
I am currently on a tier 2 sponsored visa and my husband is a dependant on me(Tier 2 dependent). Can my husband switch to a Tier 4 student visa from his Tier 2 dependant visa. And can i switch from my Tier 2 visa to a Tier 4 dependant? Can we make both applications in the UK or do we have to go back to our home country to apply.

Your spouse must apply from home country.

Once back, then you can switch within the UK to Tier 4 dependent.

Hi, thanks for the reply. However i heard that since 2013 dependants can switch immigration categories in the UK. And i opened the link but that was a tier 2 switching to tier 4 student. I asked of Tier 2 switching to Tier 4 dependant.

I also came across this on the policy guidance for PBS dependents.

Applying as the Family Member of a Tier 1, 2 or 5 migrant or an Appendix W
Worker in the UK
49. If you are the family member of a Tier 1, 2, or 5 migrant or an Appendix W Worker, you cannot
apply in the UK if you:
• were last granted entry clearance or leave as a visitor, including where they entered the
United Kingdom from the Republic of Ireland to stay under the terms of articles 3A and 4 of
the Immigration (Control of Entry through the Republic of Ireland) Order 1972 (as amended
by the Immigration (Control of Entry through Republic of Ireland) (Amendment) Order 2014)
on the basis of a visa issued by the Republic of Ireland authorities endorsed with the letters
“BIVS” for the purpose of travelling and staying in the Republic for a period of 90 days or
fewer; or
• were last granted entry clearance or leave as a short-term student or a short-term student
(child)
• were last granted entry clearance or leave as a parent of a Tier 4 (child) student


Applying as the Family Member of a Tier 4 (General) Migrant in the UK
50. If you are the family member of a Tier 4 (General) applicant, whether or not you can apply for the
PBS Dependant category in the UK depends on the type of permission to stay that you have and
type of course the Tier 4 (General) student is studying, or will be studying.

Read my response again. I did answer your question about switching to Tier 4 dependent, assuming you have sufficient validity on your current visa!! If you don't, apply from home country.
