TIER 2 DEPENDENT ILR PROBLEM

MY DEPENDENT TIER 2 ILR VISA ISSUE:-

Dear group admin and members! PLEASE SUGGEST!!

I was on tier 2 General visa and my wife is my dependent on that. My 5 years on tier 2 were completing on 09-05-2019 and my wife 5 years are completing on 30-09-2019. I was ready to apply fir my ILR on this 5 years TIER 2 route.

In Feb 2019 my company licence was suspended and after that revoked in end of May 2019.After that my all friends told me that because licence is revoked so I can not apply for ILR on 5 years tier 2 route. So I applied on 10 years route and got ILR on 06-06-2019.

THEN MY COMPANY AGAIN APPROACHED AGAINST THE DECISION TO HOME OFFICE AND NOW LAST WEEK IN JULY MY COMPANY GOT HER TIER 2 LICENCE BACK AND IT IS IN THE HOME OFFICE TIER 2 LIST TOO IN A RATING)

My Question:-

Firstly, Can my wife apply for her ILR on 5 years in October 2019 as she will complete her 5 years on tier 2 dependent???

Secondly, If she can not apply then why not? I was eligible on my tier 2 visa to apply for ILR on 5 years route basis. I applied on 10 years route due to home office wrong decision of suspension and revoke my company licence and after that I did not have any option instead of apply on 10 years route. Which is not my fault at all.


PEASE GIVE ME ANY SUGGESTION THAT CAN I APPLY LEGALLY FOR MY WIFE ON 5 YEARS ROUTE FOR HER ILR????

I WILL BE GRATEFUL FOR THAT.

1. No she cannot.

2. She can't because you applied for ilr based on long residence and not tier 2. These rules have been in place since April 2014 so it is nothing new. The sponsor licence issue is irrelevant to her visa. She has to switch to FLR m and meet all the English and financial requirements.

It is not HOs fault you didn't wait for outcome of licence issue and jumped the gun to apply based on long residence. That was purely your choice and decision and it now affects your wife who doesn't qualify for ilr as a PBS dependent.
