Tier 2 dependent maximum stay out of UK

Post by saumitra.marathe » Fri Nov 20, 2015 4:46 pm

Hi,

My wife and 2 daughters left the UK on 28th July, 2015 and now would like to come back at the end of April 2016. Is it possible to do this? If not;
- how many days can she stay outside UK at a stretch and in a year?
- what is the definition of year here: calendar year or UK financial year?

Please can you advise as I am going to India next week to discuss their move back within the right time.

Thanks
Saumitra

There is no set rule for dependents although absence should be limited and for good reason. When does their current visa expire?

Their current visa is till mid of November, 2017. The reason of visit is to look after ageing parents. My wife's mother will undergo a knee replacement surgery in January and would probably need a couple of months to recover.

Should be fine. You will need to keep record of communication with your wife to continue meeting the 'subsisting marriage' requirement. Also get some documents related to the medical reason for your wife needing to stay long.

Thanks for the clarification CR001. Would you recommend keeping UK immigration authorities informed in advance to avoid any problem while flying? If yes, what documents and proofs I should send and to whom?

Thanks

No, it is not necessary to inform them beforehand and there should be no issues flying if she has a valid visa on returning. Just make sure you maintain records of contact.
