Tier 1 Ent Ext and Child Born in UK

Dear Board Members, Zimba and others Senior,

I am asking this query on behalf of on of my friend who is Tier Ent Visa Since Nov 2014. Her Tier 1 Ent Visa was approved in Nov 14. On Feb 2015 her son was born. Since then she didn't apply his visa because she had no plan to go abroad. Now her extension will due in Nov 17. She is confused about the status of her child. She only has his birth certificate.

Can anyone tell me about what she needs to do. Is it possible if she apply his son visa at the time of her extension or she needs his visa before the extension.

Is her son is Unlawful?

In the above situation if you answer with any reference will be helpful.

Child is not unlawful nor stateless.

Children Born in Uk don't need visa to stay unless travelling Abroad.

While coming back from other country child need to have a valid visa to enter into Uk.
Afterwards child shall be treated as dependant and will need to apply for extensions if required.

If she has no plans to travel her son can stay here and apply for British Nationality after her ILR.

I will add that is was very easy for me to get visa in home country for baby before heading back to UK (when I did a visit)

I wonder if I had travelled to 3rd country what the process would be

This is not a general discussion topic. Please continue in one of your own topics if you have further questions you need assistance with.

You cannot apply for a visa in a country where you do not have legal residence (ie not a visitor), so a 3rd country would be a problem.

I was not asking for assistance at all. I was sharing my positive experience of how I did it. If you need to travel to home country (which is typical e.g. to share with grandparents) you leave UK with passport (gained in home country consulate). Enter home country (local passport) and apply there. it was 2 weeks process till visa in hand.

Hi,
Child born in UK does not require visa as far as he/she does not travel abroad. I had been student when my child was born and i did get extension but never applied for his visa until i required travelling. I was advised to apply from home country by frineds but visa was refused due to lack of child care arrangements proof though he stayed with child minder earlier and i planned to send him to same childminder.
I advise you to get his visa before you leave UK if u intend to come back, however no need to get visa with no travel plans.
