Tier 2 Extension

Hello,

I am due to extend my visa in July 2016.
My code is 2139 and experienced rate is £29900 for 37.5hrs/week
My current pay is £21300 for 26.5hrs/week

As per pro-rated calculation,
Experienced Hourly rate is (£29900/37.5hr)/52weeks = £15.3333
My Actual Hourly rate is (£21300/26.5hr)/52weeks = £15.4571.

If I calculate my hourly rate for 37.5hr i.e., ((£15.4571)*(37.5hr)*(52week)) = £30141.5094 which is above experienced rate £29900

is this acceptable for Tier 2 extension based on the above pro-rated basis?

Please let me know.

I might be wrong, but I don't think you can work less than 30 hours

I am sure it must be 30 hours if the job is under shortage occupation list not for the others.

Below information from the shortage occupation guidance

"The job must be paid the minimum salary rates shown below, which are taken from the
Codes of Practice. If you are sponsoring a migrant worker in a shortage occupation, the job
must be for at least 30 hours a week."

Below information from Tier 2 Policy Guidance

"Job in shortage occupation

97. Your contracted working hours must be at least 30 hours a week."

My code is not under shortage occupation list. So can I work 26.5 hours per week?

No you cant. when you first got your visa, how much hours were put in the cos?
If ukvi were to visit your offices today, i am pretty sure it will lead to suspension of your sponsor licence.

When I got my first visa my contract is for 37.5hr at 20300pa

My contact is going to be changed in June to 26.5hr at 21300pa and my extension is in July as I explained in my previous post is this ok for tier 2 extension ?

Even if UKIP visit office I am working according to my contract

Sorry..

Is that a problem if contract changes for my extension application?

is that a problem that in my New cos for extension if hours and income are not the same to previous cos..i,e,. reduced hours..

I would like to have some advise please. Your help is much appreciated.

well its a problem the way you want to move forward alright..
anyone can see that the main reason of reducing the hours seems to be, that your sponsor is not agreeing to increase the salary up to the level of experienced worker.
what you are suggesting is not going to work.

I can understand where you are coming from.

However, one of my friends had same situation as me . His working hours changed to 26 during extension he mange to get his visa with solicitor support

Another question.. If I get my pay to 28k at 35 hrs would it work for extension ?

Ho there..
I think the math is wrong. If your annual salary is 21,300 then your hourly is 10.24
Also...soc code 2139 is based on 39 hours and not 37.5

Oops..sorry..your calc is right. Ita just the hours bit which is incorrect. Its 39hrs.

Hello,

I have calculated 21300 for 26.5 hours not for 37.5 hours. if you calculate it for 26.5hr the rate is 15.45

hope this is clear
