Tier 2 Gen to Tier 2 Gen switch, and impact on ILR

Dear Sudhanshu,

I am changing jobs from one Tier 2 sponsor to other in Tier 2 General category.

I will be applying for an in-person appointment within this month to get the visa. I have couple of questions:

1. After applying for the visa with premium service, in how many days should I receive my BRP?
2. My new BRP is going to be valid from the 1st of March and I plan to resign from the current organisation within january (notice period of 1 month), post getting decision on the new visa. Also, I am going to India on vacation leave in February. Can I return to the UK with my current BRP (issued in Aug 2013, due expiry June 2016) within february?
3. If the current company is very proactive and decides to cancel my current BRP immediately after resignation, I understand I can remain in the UK for 28 days on the current BRP. Suppose the BRP expires on 27th Feb and the new one starts on 1st March, leaving a gap of 2 days between BRP, would it affect in calculating my continuous period of stay in UK in consideration for ILR?

Would highly appreciate your help on this.

1. Usually within 10 days.

2. Your new BRP will be valid from date of issue which is within a couple of days from your in person appointment. BRPs are not post dated. If you have your new BRP, you need to enter the UK on that, your old BRP will be cancelled.

3. Once you get your new Tier 2 visa, your old BRP is cancelled.
