Tier 2 General Dependant Visa

Hi I am new to this forum, Would anyone please help me on this.

I am on Tier 2 General visa and my wife is on ICT long term visa. She want to change to Tier 2 general dependant now.

1. I understood that this can be done while in UK.
2. Does she can apply dependant visa while she is serving the notice? Or she should change to dependant visa first and give resignation to employer.
3. What will happen if she did not get the visa before her notice end time if we are applying the visa when in notice period? Can she be in country while the visa is still process.
4. We would like to apply for our daughter to dependant visa as well. Can this be possible that my wife can apply super priority service and for my daughter standard application?

I know that we can apply now and change her status from ICT to tier-2 general and inform the employer about the visa change and serve notice. But we can not do this as I am out of country so my BRP with me. Since her joining date is in 5 weeks(They can not extend the offer any later) and her notice period is 4 weeks and i will be returning only 3 weeks later (as i am on official trip).

Anyone help us please.

1. Change to Tier 2 Dependent yes.

2. Up to her. There is no requirement to be employed for Tier 2 Dependent visa.

3. She stops working and the employer informs HO. Her visa will likely be curtailed but should have no impact if she has already applied for Tier 2 dependent. She can remain in the UK yes.

4. Ideally you should apply for them together, especially if the daughter is currently dependent on her ICT.

I am sure you mean 'Tier 2 Dependent'. Why are you overseas??

I am sure you mean 'Tier 2 Dependent'. Why are you overseas??

Yes its dependant visa. I am outside of uk in official trip. So i am having my BRP with me as i need it on my return.

Since the offer is confirmed so we are thinking of giving notice and on my return we apply dependant visa for all together. Hope that will all get thru before her notice ends or else also as you mentioned its not an issue to stay at country while the visa under process.

What 'offer' are you going on about??

A job offer is completely irrelevant to her dependent visa application and has no bearing on anything. It is her personal choice. Until she has her new visa, she cannot work for the new employer.

The only reason why i have asked can she submit the notice then apply Visa is there any gap will be consider while doing her ILR. I am due to ILR in 2 years time. She will be completing 10years in a Year time. So she can apply for ILR in a year time. Is that any issue during the ILR processing time as technically once she submitted notice she is out of Visa and until she goes to dependant visa appointment she is not in a proper visa. Please let me know is there a issue?

You are overthinking and misunderstanding the rules completely.

There is NO employment gap rule anymore. Even if there was, it was relevant ONLY to Tier 2 General and NOT an ICT main visa holder applying for Tier 2 Dependent.

OK let me rephrase. My wife is on a tier 2 ICT established staff visa since April 2011 so she will be eligible to apply for ILR through the ten year route in April 2021. But now she has a job offer so she wants to switch as my tier 2 general dependent (along with my daughter) so that she can take up the new job offer. So please can you advise
1) when should she switch to a dependent? After resigning and during her notice period or should she switch first and then serve her notice?
2) If former then there will be a period when she will no longer have a valid ICT visa(her employer will inform UKBA and revoke her COS as soon as she resigns) for her stay in the UK before she gets her new dependent visa. Lets say this period is 10 days. Will this gap count when she applies for her ILR in April 2021?

1. Either. Her current employer is only obliged to inform HO within 10 days of her last working day. Curtailment can take a few weeks to get sent and that will give her 60 days if her visa is valid for longer than 60 days. She can change visas at any time.

2. Her visa is valid until HO curtails it. It is not her employer that cancels it, only HO can do that. Unlikely she will have any 'overstay' as the process doesn't work the way you are thinking it does. However, we always advised people to at least have started the process or get their new visa before resigning but this is usually the case for change of employer on Tier 2 General. Your wife is changing visa category.

Tier 2 General Dependant Visa Validity

I am tier-2 general visa holder and my BRP ends 24dec 2021.
I would like to process dependant visa for my spouse now? Is there a option to choose lesser validity visa for them while applying. (means - less than 3 years) ? or should the validity be same like me in this case it will be more than 3 years. Please clarify this?

You can choose "3 years or less" option and they will get same or nearly same BRP end date as you. Dependents won't be given visa that exceeds the main visa holder's visa duration.

i am tier-2 general holder. i am planning to apply dependant visa for my spouse who is currently holding ICT longtime and in UK.

would you please help me for the list of documents for the dependant visa? Do my spouse need naric certificate.

1. My passport, visa, address proof, bank statement with enough fund.

TB test not required if she was living in the UK.
Document checklist is provided when you fill the application. You also need to send passport photos of dependent (write full name on back of the photos).

Thank you.

But after submitting it just asked only my wife and kids passport, biometric card and proof of fund.

It does not even asked my Passport, BRP card, bank statement, employment reference, marriage certificate, birth-certificate like any? is that not required at all?

If you have submitted those proofs in previous application then they may not ask you again. They havent asked me to submit my passport or BRP for my kid's first visa application probably because we submitted his UK birth certificate.

Urgent help please :

While filling the UK tier -2 general dependent visa application i see below question about

What is the length certificate of sponsorship?

Please help me - do i need to count the length by work end date from cos.

based on this IHS and visa fees getting calculated I guess. since my work end date mentioned in cos 10th dec 2016 and brp valid till 24th dec 2016. In both case if i apply now it get calculated More than 3 years.

there is no option to choose less than 3 years for dependants.

The main Tier 2 general visa holder's visa was issued in Dec 2016 and is valid until 24th Dec 2021 (issued for 5 years). So for a dependent while applying today(5th Dec 2018) is there an option to get the visa valid for 3 years (or less) ? If yes then where can that be specified?

While filling out the application form for the dependents it asks 'what is the length of the main holder's COS'? there are only 2 options - 3 years or less & more than 3 years . Since in my case it was issued for 5 years, I chose 'more than 3 years' and later there it doesn't ask anywhere else to specify for the dependent visa duration. Think based on the COS validity it calculates IHS for 3+ years and visa fee as well.

please advise. I need to apply for a dependent visa ASAP for less than 3 years

In that case even if you choose 3 or more years for dependent you will still be charged for 3 years + 20 days. You would get refund even if you pay more now. That's my understanding but others may correct me if I got it wrong.

Sorry to ask more regarding this.

As per the previous thread - I understood that I can apply for less than 3 years. but while filling the application form online there is no place its asking me for this option.

In the application - Its asked my Tier-2 visa details. thats where the question

What is the length of my COS? -- Here I put 3 years and over (as my Visa valid till 24th Dec 2021 So its 3 years and 20days or my Work End Date in COS says 10th Dec 2021 - In this case its 3 years and 5 days)

Then I filled all my dependant details. No where it asked to choose 3years or less?
at the end of application it took me to IHS fee. IHS fee calculated for only 3 years.
There I see Visa Type field is populated with 3 years and Over for my dependents. Which is un editable :(
At the end it gives the visa fees with 1408 pounds.


I am not sure what i need to do now? is that calculated based on my COS length time? for 20days or 5 days i need pay for double visa fee. Since its urgent query, I am not sure how to proceed. Any one can help me please.

You need to select your CoS duration as more than 3 years as that is what it is.

Your dependent will only get a visa with the same expiry date as yours, not any longer. There is no need for you to state the dependent visa duration, HO know the rules.
