Tier 1 (High Skilled) dependency visa; route to BC post ILR?

Post by christae » Tue Mar 29, 2016 4:37 pm

Hi

My husband was on a Tier 1 PBS Highly Skilled visa, currently has ILR and has his BC ceremony scheduled for April 16.

We have been married since Dec 2012, and I became a dependent on his Tier 1 PBS visa in Jan 2013.

I understand I should be able to quality for ILR after 5 years of continuous residency in the UK (and assuming I meet all other criteria), i.e. Jan 2018.

Question: will I be able to apply for BC directly after obtaining ILR, based on the rule that you can apply for BC directly after obtaining ILR if you're married to a BC? Or would I have to wait another 12 months after obtaining ILR i.e. be able to apply for BC only in 2019?

Thanks in advance!

C

You will be able to apply as soon as you have been granted ILR, provided you meet all the standard and good character requirements.
