Tier 2 ict to tier 2 general

Hi Gurus,
I am currently on tier 2 ict, pre 6th April 2010 category, but could not get ILR as I was away from country for 1 year. However on same visa , I travelled here in nov 2014. I again got extension and my current visa is extended till may 2020x

However, I have got a good recommendation from my ex-college from the current company and he has offered a job to me. RMLT will compete tomorrow. I had told them that , I would resign only once I am offered Cos from the new company. Which they have agreed to.

I have 90 days notice period. What shall I do about cos start date? Like I don’t want to be in situation that present employer curtail my visa and also that I give resignation without having any clarity on COs start date from new employer. Can you suggest a safest approach.? I am eligible for aiLR on nov 2019. Just don’t want any gaps between these visas.
Please help

It is not your present employer that curtail your visa, it is HO and your present employer only informs HO within 10 days of your last day of empyment which triggers the curtailment process.

Note also that just getting a CoS does not guarantee you will be approved for a visa.

Thanks Cr001,

I have got the Cos from May 2019 onwards. My new employer has arranged for same day visa appointment and hopefully it will be done in next 20 days.

I have 90 days notice period , as I am in ICt, my company can ask me to go back to India .

Can you suggest what I should be prepared with, so as to avoid any gap in my visa or employment ? I don’t want to risk my ILR anyway, which is due in November 2019.

I believe as long as you have your new BRP card in hand you can travel out/in without risk
