Hi,
I appreciate your help for my queries.
I have got my ILR last week through Tier 2 Skilled Worker Visa and My family is on Tier 2 Skilled worker Dependent Visa which is expiring on 18/10/2023. They are eligible for ILR in two years time. We have to travel to India on 30/09/2023.
My questions are,
1. Can I apply for Tier 2 Dependent extension outside UK?
2. If I cannot apply for extension outside UK, I will apply for Tier 2 dependent visa as a new application, does it affect their ILR application in future?
ILR guidance does not mention anything about it. It says that as long as the applicant apply before their leave expires, it should be fine. I have copied that info below.
On Page 16:
https://assets.publishing.service.gov.u ... 2.0ext.pdf
On or after 24 November 2016:
The continuous period is maintained if the applicant either:
• leaves the UK with valid leave, applies for entry clearance before their leave expires, is granted and re-enters the UK using that entry clearance
• applies for new entry clearance within 14 days of their leave expiry date, one of the circumstances below applies, their application is granted and they re-enter the UK using that entry clearance.
Could you please someone advise me that my interpretation is correct. If not then I have to apply for the visa extension in UK using Priority service before leaving the country.
Many thanks.
