Tier 2 visa

Post by smohite » Mon Nov 27, 2023 1:35 pm

Hi ,
My contract with employer A finished and was supposed to start with employer B and my visa was converted to employer B visa . Now I got a new offer from employer C , which is the job I want to join , but this job will start in Feb 2024 . But employer B said that since I will be working only for short time with them , they don't want me to join and will cancel my visa and offer the post to someone else .
I have already done my visa application with employer C and it's in process . My current visa with employer B is not yet cancelled , and I will not be working with them .
In this scenario
1) when should the employer B visa be cancelled? . I told them as soon as I get the employer C , BRP , I will notify them .
2) Since my job with employer C starts only in Feb 2024 ,can I do locum work till Feb 2024( I work in healthcare sector ) .If yes , how many hours legal .

My job with employer C will be for 4 years ,( mentioned on COS) and my BRP with employer C will be valid from the date of issue . In this case my BRP duration will be for longer with employer C than mentioned on COS .

1) The employer needs to inform the Home Office that they're no longer your sponsor. You don't need to notify anyone about it.

2) You cannot work whilst your new visa application is in process.

Neither an employment gap nor the lack of a salary between jobs have an impact on any future ILR application.

There's members with more than 80 days between jobs and their ILRs have been approved with no issues. As far as I know there's nothing explicitly mentioned in any guidance about these 'gaps'.

From your initial post it seems you're still a few years away from ILR? The current rules might not be the same in the future, these are periodically changed!

No it does not.

You can do the test whenever, it makes not difference when you do it before applying for ILR.
