ILR and then British Nationality?

Post by balixonline » Mon Oct 08, 2012 1:08 am

Hi,
I have been living legally as an International Student in UK since 11/2004, got married in 02/2011 and was then granted Spouse Visa till 04/2013. I am intended to apply for ILR in 02/2013. I wonder how long do I need to wait to apply for British Nationality once i am in reciept of ILR.

Thanks.

No, she is Lithuanian. Although she has been living in UK for a while now about 8-9 years, works n all.

I was granted Spouse visa for 2 years which UKBA usually does for British nationals as they didn't treat my application as spouse to european national. hence, did not grant 5 years european but 2 years.

i dont know if i am making much sense here.. lol

Assuming your Lithuanian spouse has settled status in the UK:

No earlier than the 1st anniversary of the date you are issued settled status.

I wonder if anyone can help me please. I came to UK in 2004 being a student. Whilst being a student I got married to European national but settled in UK all her life. I applied for Spouse visa in 2011 which was granted for 2 years. Now Its been 2 years since i got married and I need to apply for further residency.

The question is;
Do I have to apply for ILR or can I apply for British Nationality since I have been in UK more than 8 years legally?

Cheerio.

You require ILR for Naturalisation.

Thank you very much for your response. So, I need ILR For Naturalisation? Means I need to apply for ILR first which I am intended to send my application this Saturday 23/02/2013.

Once ILR is received how long do I have to wait to apply for Naturalisation? (being 8+ yrs in the country legally including 2+ yrs as a spouse)

Thank you for all your help.

The laws have not changed to make these answers different.

Though if your EU wife was granted BC then providing you meet the other rules you could apply for BC straight away.

Hi,
Thank you for the information. As you said if my wife was BC. Which she isn't at the moment but she is considering applying for BC next month. Does this mean we both can apply at the same time or how does it work please?

Once she is a bc then providing you've got ilr and been here for 3 years then you can apply as soon as she's had her citizenship ceremony. Otherwise you can wait till you've had ilr for 12 months and lives here 5 years then apply together. That'd be cheaper, unless you want bc ASAP

When applying for bc use the NCS and it should take approx. 6 weeks at the moment.

2-3 months after biometrics. If you'd have used the SCS then usually a bit faster and you get to keep your documents.
