ILR before 84 days

Post by sjidh » Sat Jan 26, 2013 2:43 pm

Hi

Currently I am on Tier 1 (expiring on 21-10-2013) but I would complete 5 years in UK on 13-01-2014.
Can I apply for ILR this October? Similar experience people, please share.
What is the validity of Life in UK test?

Thanks!

Give full details of your visa dates and categories with EC date to get right advice

Life in the UK test is valid forever once you have passed it provided you keep certificate safe with you.

You have not given the details. What is being asked for is :

Date Entry Clearance was issued?
Date of first entry to the UK?
Date of any extensions?
Date of extension expiry? 21-10-2013

The requirement is 5 years residence, so you will probably have to apply for an extension based on the limited information you have provided.

Based on the fact that you entered the uk within 90 days of entry clearance being stamped, by October 2013 you will have met the 5yr qualifying period.
You need to check other attributes though I.e. absences, earnings, etc to ensure that you are ok.

You will be eligible to apply from upto 28 days before the 5th anniversary from 21 - 10 - 2008 as you first entered the UK within 3 months of EC.
