Some help please: ILR & citizenship for family

Dear friends,

I am a naturalised british citizen & my wife as well as 2children ( aged 12 & 8 yrs, both born in india) were given dependant visas.

The visas were from 17-08-2006 until 13 oct 2008.

My questions are :

1) When is the earliest she can go to the home office in liverpool to apply in person?

2) Can the children apply for citizenship soon after obtaining ILR ?

3) My wife has to decided to continue on ILR rather than taking British citizenship. Is it advisable in present climate ?

I would recommend that she applies for ILR as soon as she qualifies.
Proposed regulations are due to be put before Parliament this Autumn, and if passed, ILR will no longer exist. It will be replaced with 'Probationary Citizenship', and won't be permanent residence. It will also take longer to qualify for Citizenship, unless you take part in community projects or charity work. More involved than that...but that's the gist of it!
When can she apply for ILR? 28 days before the equivalent date she first entered the UK on her 2 year spouse visa. What date did she enter and what is the expiry date on the visa?
Has she passed the Life in the UK test?

she has passed life in uk test.

is it 28 days before 13 oct 2008...ie.. 16-08-08

It's 28 days prior to the date she first entered the UK on the visa. That's why I asked when she entered.
The date of expiry is 13th October. But what was her entry date in 2006?

What do you mean by entry date?.She did not go out of the country since aug 2004

In that case you are not making sense as you talk about visas first issued in 2006.

If your wife and children were granted FLR(M) (285 & 302) for two years, then they may apply for SET(M) (288 & 299) before her FLR(M) expires, but no sooner than 28 days (4 weeks) before it expires.

Shouldn't it be anytime after 21-Jul-08 (28 days prior to 17-08-08, the day 2 yr. requirement is fulfilled and dependents become eligible for ILR)?

Visa issued prior to 17-08-08 not being considered ('coz unkown).

just to clarify

though i have been living in uk from 1998 my wife since 2004 i came under the long stay category & received my ILR in oct 2006 . when i received ILR they gave my wife & children the dependant visa which is until 13-10-2008.

hence the question when is the earliest they can apply for ilr?

can the children then apply for citizenship straight away

They may apply for SET(M) between 19 September 2008 and 13 October 2008.

See also can my children apply for UK passport ? They should be eligible to apply for citizenships immediately after being granted ILR.
