Hi all,

I hold a Canadian passport and I am currently on a Tier 2 General visa. My visa was originally valid until 2017 but unfortunately I have recently been made redundant by my sponsor. My last day was 27 October 2015 and I understand my sponsor has already notified the Home Office. I know I should expect a Curtailment Letter stating I have 60 days left in the country, but this has not yet arrived.

Extra background: I have another job offer from a new employer and potential sponsor, but they are unable to transfer my visa until end of November.

My dilemma: I have travel planned from November 3-19 and will be seeking re-entry to the UK on the 19th. What are the chances my entry will be refused because my employment has just ended? (Keeping in mind I hold a Canadian passport so can enter as a visitor with no visa)

I called UKVI 4 times and no one was able to give me an answer so I am really hoping any of you can help!

Travel when employment has ended and sponsorship been terminated should be avoided. You may be refused entry since you do not hold "valid sponsorship as a Tier 2 migrant".

Thanks @sushdmehta. How do they decide if they'll refuse entry? It sounds like it's at the discretion of the border guard, which seems odd.

It does not matter that I have not received curtailment yet and would definitely be within the 60 days?

Also, could I instead re-enter as a visitor? As Canadians we can stay as a visitor/ tourist for 6 months.

Even if you are lucky enough to be admitted as a visitor, which is doubtful, you would not be able to switch to a Tier 2 visa from visitor status.

There was recently a post of someone who tried to do what you want to do and and also had travel plans. They were refused entry as their visa had been curtailed and and they were in the curtailment period. The person had to return to home country and apply for a new Tier 2 entry clearance visa.

also ukvi doesnt issue curtailment letter if the person has left uk (even if it was intended for few days like in your case). you will be stopped at the border since your cos would have been cancelled.
if you do go back to your country, you will have to wait for 1 year (cooling off time) before you can apply for tier 2 again.
