Treaty Righs?

Post by MB27 » Fri Nov 06, 2015 1:52 pm

Hi

I am an A8 national and have been to the UK since June 2006.

I registered with WRS on 8 December 2009 (employer at the time 1 April 2009 - 10 June 2010). Is it the case that there is a requirement for a minimum of 12 months employment with the employer with whom WRS is done?

Does this mean that 5 years from that date I automatically become entitled to PR?

8 December 2014 + 12 months and I should be eligible for BC?

I have just received a letter from HO informing that my application has been refused and I cannot quite grasp why.

You had 28 days after commencing employment to apply. From April to December is a lot more than 28 days.
Then you registered in December 2009 and work ended in June 2010. That is less than 1 year person. And even if you managed to find a new work and re-registered after June 2010, the earliest time you would have qualified for PR is December 2014 and the Earliest time you could apply for citizenship is December 2015.

Therefore refusal seem appropriate in your circumstance, with new rule changes , you will need a PR certificate to reapply.

What is it you applied for (& have been refused)?

Hi

Thank you for your replies.

I applied for British Citizenship (AN1).

I attach a copy of the refusal letter.

Does the reason as outlined by Obie (thanks Obie) still stand?

Does this mean I will not be eligible to apply for PR until 2016 (abolishment of WRS + 5 years)?

Many thanks

All what I advised, still stand.

That is a generic statement, any particular reason was given for the refusal?

Attached is the letter sent to me just before the refusal letter.

They make references to the WRS and the 12-months period.

I replied and provided additional documentation in regards to my employment since 2009.

Does this mean that essentially the fact that I did not work for the employer with whom I registered WRS for another 12 months since the registration was the reason for the refusal?

Hi

I light of the above, can I still assert that the reason why the application has been refused was that I did not complete 12 months from the WRS registration with the same employer I registered in 2009?

I do have evidence I worked for that employer for more than 12 months, but yes - I had left before a period of 12 months from the registration passed.

What would my options be now if I still wanted to apply for citizenship in the future?

WRS was abolished in 2011. Does this mean in 2016 I may apply for PR and then after a year (if successful) can apply for citizenship again?

Many thanks
