actual start date vs cos start date for Tier 2 change of employment

Post by docmail » Sat Jun 01, 2019 11:47 pm

Hello,
My new employers Cos start date is 06 july 2019 for tier 2 change of employment application, however i want to start on 06th June . my past employer tier 2 visa was valid till 20th july 2020.
I received HO letter that this new tier 2 visa leave is granted hence CoS is used. From the various posts i distill that the new employer has to put a revised/actual start date via a sponsor note on the SMS and that is all whats needed to legally start working for the new employer. Hence in this case he/she needs to put 6 th june as a actual start date on SMS via sponsor note. Thats all.
Am i correct?
Regards
A

My understanding is that as your visa has already been approved and issued, you cannot work for your new sponsor until the cos start date etc.

Hello
Thanks. please update if my thinking is correct
Page 6 of the below document says that a start date can be changed on sms after it has been assigned

Your CoS is already used as your visa has been issued. It might have been bale to note a change before it was used.

Thanks. You are correct, however i just came across a recent HO amendment on point 23.9. If i understand it correctly, I can start working minimum 28days before the CoS start date but after the BRP valid date.
https://assets.publishing.service.gov.u ... _FINAL.PDF
Again a sponsor note is must and enough, correct?

I am also made aware of the 14 day rule, in the below link, but i think this is for those who are entering UK on first time Tier 2 visa. Am i correct? so its not valid for me?

23.9 the way I understand means 28 days a AFTER the leave to remain or original start date.

I will leave other to comment further.

Thanks, if one looks at tier 2 extension it states that on https://www.gov.uk/tier-2-general/extend-your-visa

You should not start your new job until you’ve received your biometric residence permit with your new permission.

For this to make sense, 28 days can also be from the date BRP was issued...
Again comments from Gurus is appreciated...

Dear Gurus,
the HR agreed that my joining can be 28 days before the CoS start date for Tier 2 change of employment new employer visa. I have one query, upon checking my RtW for the old employer, it shows that it is still active, I guess that it will exhaust after the new CoS start date, correct?
Also, can i go for a week after i join my new employer but return 18 days before the new CoS start date?
I must be showing my new BRP, but i am not sure if the Border agent can see which BRP, new one or older one.
If newer, i dont know if he can check the sponsor note on revised start date.
Please enlighten me.
