How the CoS works in two different situation

Post by mvasudevan1984 » Mon Nov 09, 2015 11:59 am

Applicant Situation
Tier 2 G Change of Employment - Previous stay Tier 2 G <----PSW <----Tier 4
CoS removed by Current Employer. And new CoS issued by New Employer. Application made to UKBA

I want to know how the CoS works in two different situation
________________________________________________________________________________________
I read in this forum that people advising to take New employment, CoS, then apply Visa , Once successful ask employer to withdraw your exisiting CoS.

And also people saying you cant have two CoS ,(then how can some1 can apply new visa when is in live)

which is contradiction !
________________________________________________________________________________________
Two Situation

Situation 1 . CoS created , Application Made , Got Visa
Situation 2 . CoS Created , Application Not Made , NO Visa
________________________________________________________________________________________

If in the applicant situation
CoS removed by Current Employer. And new CoS issued by New Employer. Application made to UKBA

whether another employer can create CoS ? If yes , will it affect application ?

or explain me whether my understanding i right ?
Once CoS in live(CoS unremoved by employer), another CoS can be created but if CoS created (CoS removed by employer) second one cant be created

Confused with the CoS , Please help

Once the visa has been issued, a CoS is no longer live or relevant...

So you can change employment by being issued a new CoS and applying for a new visa. The new visa would then supersede the old. You cannot have two CoS issued by two separate employers and then apply for a single visa.

Thanks for your reply physicskate

So If my new submitted application is successful / refused . Then
Another employer can assign another CoS

If the decision is not made by UKBA for current issued CoS, then new employer cant issue another CoS / if he can still assign but that will not affect my current application

Hope my understanding is correct

I have another doubt please reply me physicskate

UKBA send me a mail challenging about Shortage Occupation

I got following mail from UKBA
Thank you for the application for leave to remain, which has been identified as invalid due to an omission with regards to the fee that has been submitted in support of your clients application. You have paid a fee of £728 based on your clients occupation being on the Shortage Occupation list but unfortunately we have checked this and your clients occupation is not covered on this list. We are therefore exceptionally allowing you a further opportunity to pay the full fee of £951.

We are therefore asking you to submit the following:
• The additional fee top up fee of £223. Please complete the pro forma attached to this e-mail.
The completed form should be sent to us by email to this email address as soon as possible
If you do not agree with our assessment can you please provide further evidence to confirm that you do in fact work in a shortage occupation. We can exceptionally accept evidence by email.
As your client does not meet the criteria for a Shortage Occupation please ensure that they still meet the criteria for their job including the Resident Labour Market Test.

Application made under :
SOC 2129 Engineering professionals not elsewhere classified --> Job: Project Engineer
Shortage Occupation list link : See page 3 and 4
https://www.gov.uk/government/uploads/s ... l_2015.pdf

Online application made : Friday 7 OCT 2015
UKBA reply received : Mon 9 OCT 2015
What should i do now ?
I'm worried whether UKBA decided with my job duties , but solicitor saying at this inital stage they may not gone into that ?

Please help

Resident labour market test – Tier 2 (General) – advertising methods

28.25 The following sections describe the different methods of advertising we accept when
carrying out a resident labour market test. Unless an exemption applies, all jobs must be
advertised using two of the methods set out in this section. In many cases this will be
mandatory online advertising through Jobcentres, plus one other method. Where
advertising through Jobcentres is not mandatory, you can choose any of the permitted
media to advertise in so you could choose one national newspaper and one professional
journal. We will also accept two advertisements using the same form of media, for
example advertisements on two different websites.

Tier 2 & 5 of the Points Based System - Guidance for Sponsors - Version 04/15 Page 90 of 152
https://www.gov.uk/government/uploads/s ... d_v1_2.pdf

I got a job through a recruitment agency where they advertised in many online job portals like
Recruitment company own website
www.cvbrowser.com
www.cv-library.co.uk
www.jobsite.co.uk
ww.twitter.com
etc etc (but not 100% in job centre plus)

My solicitor advising me , using below general term from policy guidance. we shall apply that RLMT carried out
We will also accept two advertisements using the same form of media, for
example advertisements on two different websites.

CR001 , Please advise how far it will work !

Can you please stop starting multiple new threads with this same query. Multiple Posting (click)

When someone is available who can answer your query, I am sure you will get a response. If you need immediate and urgently help, you are free to contact an OISC advisor for assistance or ask your solicitor.

I have removed your extra threads and merged one of them with this one.

You will need to be patient if you want free advice on the forum as we do work and have families.
