Hello Moderators and Members,

Filed for Tier 1 (Entrepreneur) migrant claim after PAP and JR Grounds and have received a Consent Order from the HO now. Relied on paragraph 245AA evidential flexibility rules and policy guidance after submitting a key document from the VC (unconditional funding availability). The HO has agreed to reconsider my application within next 6 months.

I have a few questions if anyone could answer them for me please:

1) What is the likeliness of getting the entry clearance now when the HO has accepted the new document that we submitted and I'm likely to get all 95 points?
2) Will they take exactly 6 months time starting from now on?
3) How long is the process after this? Roughly in months?
4) Will Covid-19 affect the timescale?
5) Is there a way i can track the status of my JR online?

I Always appreciate the second opinion i get from this board regarding any queries i have in my mind. Thank you so much! :D

1) The HO has not accepted the new document. They only agreed to reconsider.
2) Does not matter. Check the wording, it is doubtful that there is rock solid commitment of 6 months.

Nothing so far. Seems like the departments are slow in these covid 19 circumstances.

Hi there,

So the Home Office has failed to re-evaluate my application within the time period agreed on the consent order. It has been over 30 days from the agreed time. Solicitor has contacted twice, no response!

Can anyone suggest me what can be done now? Thanks

Hi Abuhf,

Nothing so far buddy. Its been 9 months since the HO agreed to reconsider my application. Overall 1 year and 11 months since i applied. I am all set to start my company/business within the UK, have everything ready- Funds, marketing material, sales, Advertisement etc. Especially within this Covid time, Its a great opportunity for us and we will do really well considering the business plan we have. But unfortunately EC is the first step and rest after that.

If i do not get a decision within the next 14 days, we'll take a legal action.

What about you? I think you got an entry clearance already?

My visa was refused intially and I got my visa in Admin review.

Reconsideration after JR TIER 1 UK entrepreneur £50000 GBP

Hello Moderators and members,

So the home office is reconsidering my application and came to me and asked to submit “all initial supporting documents + any representations i’d like to be considered”

Although they do have all my documents as I submitted them initially, during AR, PAP and JR, still they requested supporting documents.

My solicitor said: submit all documents that I submitted initially + during AR :idea:

Another known solicitor advised: submit all initial documents + during AR documents +
an affidavit summarising my application + a cover letter from solicitor + new letter from VC confirming funds availability :!:

I’m just very confused onto what to do. Does the affidavit or new letter have any impact on reconsideration :?:

I would appreciate any advice any members or moderators can give me asap please :oops:

I am going through same situation...they ask for six months for reconsideration ( i was in pap at that time) but one month after they ask for six months time they ask me to submit my initial supporting documents plus bank slips...my solicitor advise me to submit only what they ask for...

Right. I can see your application is an extension one. Mine is initial. Applied 23 months ago.

You will eventually get it. I see home office tend to refuse applications giving unreasonable reasons since they're in power. Currently they're just reconsidering applications so they can get more time due to covid. I escalated my case twice that is when they decided to ask for my documents although they already have it all with them!

Its been 2 nd a half year since i applied for extention...and you are absolutely right that they are just taking cases into reconsideration for the sake of time wastage..... or sort of revenge...but the whole process is so much frustrating...

Anyways i heard that when they reconsider your application it means your application stand on the initial level ...like you lodged recently and the new department with new team will look into it...so hope for the best this time

Yh mate, hopefully it’ll be done this time. My case is all genuine and I’m happy i have a supporting venture capital who has been very helpful during this process. Just don’t understand why they keep on coming with new reasons everytime. Very frustrating. Nearly 2 years now when the government website says 3 weeks for processing lol

I have submitted all my documents once again and waiting for a decision from last 2 weeks. When do you think they will give me a decision? Is Covid slowing down the process?

I guess there should be a separate topic for pap timeline as well....so people like us can get some clearity of should we expect.....
