Khanbhai wrote: ↑Mon Feb 25, 2019 5:24 pmHi everyone
I have applied for ILR application after completion of 5 years on Tier 1 Entrepreneur visa. My application is still under process after 6 months and I want to apply for my dependents visa which is going to expire on 15/15/2019. My dependent will not completed 5 years till current expiry of visa and I have to apply for PBS dependent visa for her.
Visa timeline is;
Tier 1 Entrepreneur visa extension issued 15/05/2017 main applicant and dependent
Tier 1 Entrepreneur visa expire 15/05/2019 same date for dependent.
ILR applied on bases of 5 years completed (main applicant only) 22nd August' 2018.
My questions are;
1. Please advice what visa category I use for my dependent? ( I believe PBS dependent visa)
2. Can I apply visa for her before 28 days? 28 days before expiry yes
3. What documents are required?
https://assets.publishing.service.gov.u ... 1-2019.pdf
Read the guidance
4. My child born in UK she was 2 years old when I applied for ILR application (September' 2018), I have not mentioned her in my ILR application and we also not traveled with or without our child outside UK during our visa extension time. Does it impact on my ILR visa application that I have not registered her with home office? You did the right thing. You can register your UK born child as British Citizen once you will have your ILR
5. Another child born this month do I need to register him? I want to will apply for my children's British Citizenship ones I get ILR. Is there any issue if I wait for my ILR? You should wait. No need to apply anything for UK born child. Same as point 4
6. Is my application pending because I have not applied for my dependents (Wife) visa with me? I mentioned in visa covering letter to caseworker about my wife's visa that I will apply visa for her before current visa expiry date (15/05/2019) No thats irrelevant
7. Should I contact any immigration consultant for these issues? I applied visa extension and ILR myself and always get help with this forum. No. You should be okay. Just wait for your ILR. Have you received any complex letter or any communication since you applied?
Please help and advice
you can check my case history in this post

Thanks In advance

Yes 3 or 4 additional documents, believe me I arrange them such a way that those extra documents can not bother anyone. you know what my 3 friends applied for there ILR visa base on Tier 1 Entrepreneur with same documents and got visa in 4.5 months. My case is straight forward but no luck.
They Issued complex letter within 3 weeks of application
Contacted home office after 3.5 months as I had to travel to my country urgently, asked them to issue visa and if they need any additional information from us. Home office replied next day and they sent same complex letter, but not on brown envelope letter was in normal white envelope and by different team (Temporary migration team 11).
Completes 5 years on 11 July 2019
It was online application, I have commercial business lease. I think you are right I did mistake providing more information. Last time I got visa extension in 8 months. Some people are saying it is now taking 6 to 8 months for Tier 1 Entrepreneur ILR decisions.tier11417 wrote: ↑Mon Feb 25, 2019 10:25 pmKhanbhai wrote: ↑Mon Feb 25, 2019 8:09 pmThanks tier11417 for you reply

I hope you get your ILR visa asap. Keep us updated. Did you apply on paper or online form?
Is your business registered at home address?
Btw you have not sent 3/4 more unnecessary things. You have sent like 10-12 unnecessary documents. But anyways whats done is done. You can never say how long HO takes anyways. Goodluck
Thanks Aman90 for your valuable advice
It counts from visa ISSUE date.I checked actual visa issue date is 09/07/2014 but she came to UK on 3rd August' 2014.
could you please confirm 28 days will start from visa issue date which is 09/07/2019 or UK entry date 03-08-2019?
No. If her PBS Dependent visa is granted and then you choose to apply for ILR, there is no refund of PBS Dep fee or IHS.Can we claim back PBS dependent visa fee after applying dependent ILR?
Thanks CR001, That is very helpfulCR001 wrote: ↑Tue Feb 26, 2019 10:47 amIt counts from visa ISSUE date.I checked actual visa issue date is 09/07/2014 but she came to UK on 3rd August' 2014.

Thanks again Aman90aman90 wrote: ↑Tue Feb 26, 2019 12:19 pmI think if you manage to VARY to ILR by timing it appropriately..you pay the difference in app fee and you’ll only lose the IHS surcharge..
check the forum for such cases.. and you could always request HO for refund of surcharge provided the extension application wasn’t decided. Doesn’t hurt to ask.
Goodluck for your ILR. Keep us posted. Hope we hear good news soonKhanbhai wrote: ↑Tue Feb 26, 2019 10:18 amIt was online application, I have commercial business lease. I will apply for PBS dependent visa 14-05-2019 and ILR on 14-06-2019. But last time they issued initial dependent visa in 11 working days. I hope for the best this time.
I know 2 persons one got complex letter after 1.5 months and got visa in 4.5 months and second person got got complex letter and got visa after 3 days(within 4.5 moths). One of my friend got complex letter on British Citizenship and next day he got the BC. When they need time or want to hold your application they issue complex letter.tier11417 wrote: ↑Tue Feb 26, 2019 4:55 pmGoodluck for your ILR. Keep us posted. Yes I also think they will not issue visa in 11 days, I can get 15 more days and by time they issue PBS dependent visa I will apply dependent ILR. I hope I get my visa soon.aman90 wrote: ↑Tue Feb 26, 2019 7:28 pmKhanbhai wrote: ↑Tue Feb 26, 2019 3:21 pmThanks again Aman90aman90 wrote: ↑Tue Feb 26, 2019 12:19 pmI think if you manage to VARY to ILR by timing it appropriately..you pay the difference in app fee and you’ll only lose the IHS surcharge..

My initial Tier1 was issued in 3 weeks but that was abroad.
I don’t think it’s gonna be 11 days here.
Application won’t be processed till you submit biometrics. I think it’s within 15 days after submitting online..
