Tier 1 entreprenuer ILR depenent with main applicant

Tier 1 entreprenuer ILR depenent with main applicant

Respected Members,

My sister is on tier 1 visa and her second half is her dependent. Sheis eligible for ILR on 5 years route in feb 2019. She has valid visa till October 2020.

I have two point to get valueable advise.

1- her dependent came to uk in june 23 in 2014 and he got visa in April 15 in 2014. Which date we can use his ILR. The visa date or uk entry date to qualify for ILR 5 years counts.

2- can we use the new premium service by paying £610 extra for applications. As when i check home office website for online it says we can pay extra for expedite service however when i tried her fo online it doesn’t show at the end of application this new fast service £610 extra. Anyone know why is this not shown when we are trying to pay the fee for premium service.

1. To be safe, it should be June 2019 as the immigration rules specify that you have to have been living together in the UK for 5 years. However, there have been cases here approved based on visa grant date. Why take a risk for 3 months sake?
2. The old premium service is no longer available

The expedited service is not available for all categories. So if it is not available for you (e.g T1E) then you will not see the option

If she applies alone, given dependent has valid leave till Oct 2020, and she is granted ILR, then she can opt in for super priority 24 hour service for dependent only. Main applicant can only opt for standard service.

The main applicant can apply in Feb 2019 alone, given dependent visa validity is till Oct 2020, she can apply for dependent after June 2019 so will have 5 years living together (highly likely her ILR approval will take around 3 months or more anyways) and then can rather use super priority additional £610 for dependent. This will save time.

You have to apply online now with the new service. The standard time is 6 months. But there are many cases where ILR via Tier 1 is approved in 2-4 months. Depends on individual case if that takes longer HO will let you know.

My ilr has been wirh HO for 13 months and still no response. So be patient when you apply as its handful cases which were decided within timw framw. And I also think that my case is straightforward as my extension was done in 6 weeks

Are you Tier 1 Ent? Were you interviewed at extension stage? Were you sent a complex letter at ILR stage?

I agree time varies on individual cases so you cant really say. Majority cases I have seen which are reported on this forum via Tier 1 to ILR were successful in 3-4 months.

So then as per HO, your case is complex to them. My extension was straight forward to me but it took 16 months for HO to decide as per HO it was complex. I hope you get your ILR soon.

Really. It is long time man. I would say this is unbelievable that your ILR file is pending that long. please keep me posted if you hear something from homeoffice. good luck

Sure. I even contacted my MP but the same generic response saying my case is complex
