UK born baby applying dependent visa from Pakistan

Dear all
I am on Tier 1 general visa and eligible for ILR in Dec 2016. Need to travel to Pakistan due wife’s ill health and no time to get visa for baby before travelling outside UK.

Please if anyone cane help with my three questions

1 - can we apply dependent visa from Pakistan without and legal issue?
2 – Since he is UK born, so do i need to pay any NHS health surcharge for him to apply from Pakistan?
3- while making ILR application in Dec 2016, does he needs to be added? OR do he need any extension? OR he can just be registered as British without applying ILR/extension?

If anyone recently applied under such circumstances from outside UK then please share your experience.

1. Yes, no issue.

2. Yes, it will be payable whether you apply for the dependent visa within the UK or from abroad.

3. No. Once you get ILR, you can register him as British, he does not need ILR or an extension/valid leave to remain.

I am on Tier 1 Gen visa in UK..my UK born baby had to travel to Pakistan in Mar 2016 and now I am applying for dependent visa from Pakistan. Few questions in this regard:

1 - noted online visa application facility is only for visit visa, so which form in need to complete under above category?
2- which supporting documents are required?
3- how can I pay NHS health surcharge if not applying online?
4- not sure they issue a BRP or a sticker visa? if so how long its valid to travel back..i heard they issue a limited visa then once in UK then BRP will be issued? not sure

1. It is an online application. See Tier 1 General - Family Members (click).

2. Read the guidance notes. Don't forget the maintenance funds.

3. You have to pay IHS online before you can submit application. See IHS (click)

4. When does your current visa expire? Likely to be a sticker in the passport valid for 30 days. You will need to collect the BRP from the Post Office once the child is in the UK.

just to double check..i dont need to apply ILR or ext for uk born baby..? although he will hv a visa now to come back to Uk???

A UK born child DOES NOT required valid leave or ILR to register on MN1 as British under section 1(3) of the nationality act. It is an entitlement to register and cannot be refused.
