ILR and maternity

Post by Majeed39 » Tue Jun 25, 2019 2:32 pm

Hi there
I am currently on Tier 2 visa waiting for new COD to extend it with the same employer.

I am pregnant and due to have a baby in December.

Next year October time, will be my 5 th anniversary of work in UK:

My questions are:

1- Does maternity leave count toward ILR clock?

2- Am I allowed to apply for ILR during my mat leave?

3- Will it be a problem to earn less than ILR threshold while on mat leave?

Thanks in advance

1. Yes.

2. Yes.

3. The guidance notes explains this. https://www.gov.uk/government/publicati ... r-2-worker

You must still be employed by your sponsor for ILR and you must the the relevant letters about absence and required for the foreseeable future.
