Switch Tier 4 PBS dependent visa to Tier 2 General visa

Post by Nandakumar_Sankar » Thu Jun 06, 2019 1:20 pm

Dear All,

I'm currently on a Tier 4 PBS dependent visa and I work as a full-time employee in the UK. If I need to be sponsored by my company with a Tier 2 General visa,

1. Will I have an exemption from the resident labour market test?
2. I work a s a Senior QA with 8+ years of experience and my responsibilities includes handling team(s), will this fall under Shortage occupation list ("2133 IT specialist managers")?
2. Are there any other assessments I need to be aware of?

Thanks

1. No you are not exempt from the RLMT as a Tier 4 dependent visa holder. You will only be exempt if it is a shortage occupation role.

2. Possibly. It is your sponsor that decides the correct SOC from either Appendix J or Appendix K based on your job description and role.

3. What do you mean 'assessments'??

This is for your employer to deal with when creating your Certificate of Sponsorship.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Appears they are liable yes. Only tier 4 main visa holders employer would be exempt.
