Non disclosure of spent convictions

Post by Odius » Thu Jun 06, 2019 4:38 pm

I am kindly asking, my friend's husband previously lived in the UK. She applied for General Tier 2 for herself and PBS for her children and husband. Her husband did not declare criminal convictions as he thought he did not need to as they would have been spent. His application (under 320 7A),and the children has been refused. Is there anything he can do

When were the convictions and what were they for?

They were between 2003 and 2005. Driving without a licence and domestic abuse. Many thanks

What was the wording of the refusal letter?

Why did he not declare them in the form where it was asked?

Tough one as he has been refused due to deception or withholding material facts.

https://www.gov.uk/guidance/immigration ... or-refusal
(7A) where false representations have been made or false documents or information have been submitted (whether or not material to the application, and whether or not to the applicant’s knowledge), or material facts have not been disclosed, in relation to the application or in order to obtain documents from the Secretary of State or a third party required in support of the application.

Note that your children will not get a visa either unless your husband is able to get one.

They could try to reapply and he can explain in a covering letter etc but there is no guarantee of success.
