Eligibility for ILR if on spouse dependant Visa

Hi Team,

I'm reaching out to you to understand the implications on my visa considering my husband's visa switches from Tier 2 General to ILR

I've been on Tier 2 dependent Visa since 15/08/2015 and my current visa is valid until 11/11/2019

Given my husband switches to ILR this November i.e. 11/11/2018
- Do I have to switch to ILR dependent this year itself?
- If yes, Do I have to complete 5 years solely on ILR dependent
- If not, does that mean I will have to change my visa closer to expiry data i.e. 11/11/2019?
- If yes, will the years on Tier 2 General Dependent (which will be close to 4 years and 3 months in November 2019) be considered towards my ILR and I'll need to take ILR dependant visa for additional 9-12 months until I complete 5 years in this country?

No.

No.

You can continue to stay on and extend your Tier 2 Dependent visa. See link below.

Please could I confirm if I've understood correctly

So i'll extend my Tier 2 General Dependant Visa after 11/11/2019 (which is the expiry date of my current visa) until Aug 2020 OR until July 2020?
- I received one month visa - from 22/07/15 to 21/08/2015 during which I was supposed to fly and collect my BRP in UK.

I believe I will be eligible for ILR 28 days prior to my visa start date?

You must apply for an extension BEFORE your current visa expires.

An extension will be for a 3 year visa.

Yes you can apply for ILR within 28 days before the 5th anniversary of your visa start date in July 2015.

As the rules are changing, and my Visa extension is nearing (i.e. Nov 2019), please could I confirm if the earlier advice still stands true in my case

Apply for Tier 2 dependant in Mid of Oct 2019?

If yes, please could i understand the approx fees? I understand I'll need a visa for a year, but i suppose the extension has to be for 3 years?

What rules do you believe are changing?? Nothing has changed since last year.
Apply for Tier 2 dependant in Mid of Oct 2019?
At any time before your visa expires.
If yes, please could i understand the approx fees? I understand I'll need a visa for a year, but i suppose the extension has to be for 3 years?

Current fee (likely to go up in April) is £704 plus the IHS fee of £1,200. It is a 3 year extension, you cannot apply for a lesser validity visa.

Hi team,

You simply need to answer the questions in the tier 2 dependent form. It is not complicated.

You will get a 3 year extension.

We tried to start with the Tier 2 application online, in which they are asking for COS details to proceed.

We don't have COS details anymore as my husband has got ILR. Please could you help us understand the best way to proceed with my application?
