hi out there!
i am an undocumented african asylum seeker with a european citizen spouse.my asylum application is on appeal.
but the ting is that the immigration office have doubt on my identity because i am not able to provide any kind of documentation about me.
but on the other hand,i was allowed to get married.(if they doubt my identity,why they allowed me to get merried?)

my wife and me have applied for familly reunification,and for a temporary working permit that will allow me to stay in the country during the process in case my asylum application is turned down(i hope not:-).).
there is a new law in the country saying that i should go back to my country of origin and apply for familly reunification from there,but that is not possible for me as i face great danger in my country.

=so what happen if the immigration office ask me to leave the country?
=what happen if the familly reunification application is turned down too, and all that because of doubt on my identity?

please help me to see clearly in this situation.i love my wife but i am affraid that the immigration services might use the fact that i cannot prove my identity with documents,to reject my familly reunification application.

Did you apply for COA from Home Office? Did they actually gave approval? Did you register your marriage in local registry office in UK?
If you have applied to COA, what identification document did you provide. Surely because of your immigration status, you are not eligible to be granted COA Unless you are from a war torn country or country like zim.

That is right. No there is no switching rule which makes people without stay or overstayer to go back to there country of orgin to get enty clearance. I was one of them who went back to my country of orgin despite danger of getting killed or kidnapped. Unless you have a compassionate grounds to stay in UK and apply, you don not really have a chance.
so what happen if the immigration office ask me to leave the country?
As I said earlier go back to the country of orgin and apply for entry clearance in nearest British High commission. Its easier and quiest way to legalise your stay in Britain. I can not see any other way round your situation unless you country of origin is deemed as dangerous to land and there is no British high commission in your country. By the way which country are you from??

i am from democratic republic of CONGO
and my wife and me are living in NORWAY.

and the option to go back to congo to apply from there is not possible,
because at 99 per cent of chances i'll not be back.

=and my marriage is a real one,we are together since more than a year,i have been accepted in her familly,her son(who is my step son now) and her friends.to make it short, we love each other and we can prove it to who ever.
=but i don't know how the immigration office here will deal with that case of someone in my situation!that's why i am worrying.

=CAN SOMEBODY IN THIS FORUM HELP ME TO PLEASE?thx.

lewarrenb, the problem with your situation is that if there is no way of proving that you are the person who is married to the EU national, then I know of no rules that may of help to you.

Incidentally, why are you asking about it all in a UK family member forum if you are in Norway?
