Work visa to ILR (completion of 5 years)

Post by zeeshanali123 » Sat Apr 29, 2023 6:33 pm

Hi Everyone,

I am in a confusion if anyone could help or guide me in this, would be great.
I obtained work visa (5 years as defined in CoS) on July 2022.
On my decision letter it is mentioned that I can work from 23 June 2022 to 14 June 2027.

I came in UK on 19th July 2022 and started my Job on next day i-e 20th July 2022.
I paid my visa fee and IHS for 5 years.
I came along with my dependents.

Question is :

1) How my five years will be completed?, there will be some difference in days or month.
Because for ILR application in the future, it requires 5 years to complete. As per my dates as mentioned above , is it fine ?

Looking for expert advice on this please.

Thank You,
kind Regards,
Zeeshan.

The job start date is irrelevant. The 5 years starts from the date of first visa approval

Spouse visa use date of entry into UK while work visa route to ILR use date of approval/decision made there your date of interest starts 23rd June 2022.

The visa approval date may not be the same date as the CoS start date. CoS start date is irrelevant to ILR. If the visa approval date is indeed 23rd June 2022, then you are eligible for ILR from 26 May 2027 onwards.

Update on Skilled Worker Dependent Visa

Post by zeeshanali123 » Sun Oct 27, 2024 7:58 pm

Hi,
I am wondering if I can get help and guidance regarding below question, please.
I have been living in here from 2 years under skill worker visa (5 Year visa route) along with my dependents.
Recently, I have updated my visa ( Got new CoS of 5 year again) due to different Job role and due to different occupation code within the same employer .
After completing 5 years, Can my dependents apply for ILR or first do I need to update thier visas then ILR? It will cost me more money.
Since I have changed my visa due to new job role and new occupational code?
On Gov site, it is saying that before the expiry of dependent current visas you can update thier visas. But I am looking to apply for ILR.
Any guidance in above, please.

Thank You very much for your help.

Best Regards,
Zeeshan.

1. Do NOT tag your questions onto topics that do not related to your visa route for ILR!! Post split to its own topic!
After completing 5 years, Can my dependents apply for ILR or first do I need to update thier visas then ILR? It will cost me more money.
They can continue on their existing dependent visas. No need to 'update' or apply for them again. They apply for ILR at the same time as you or after you. They cannot apply for ILR before you do.
Since I have changed my visa due to new job role and new occupational code?
They are dependent on YOU, not your employer sponsor.

Hello,
One more quick question please and thank you for your guidance earlier.
My dependents are on my previous visa (skill worker dependent visas).
On thier decision letter it is mentioned that they can stay from 23 June 2022 to 14 June 2027.

I came in UK on 19th July 2022 along with my dependents and started my Job on next day i-e 20th July 2022.
As per above details, would I be able to apply for ILR along with my dependents? Are we completing the 5 years period that will make us eligible to apply for an ILR?
Your guidance will be much appreciated.

Thank you.

I really appreciate your time on this.
In that case I don't need to update their visa status, right ?
As per above dates, when is the best time to apply for an ILR?
Thank you again for your guidance and time.

Thank you very much for your guidance and time.
So in this case I don't need to update my dependent's visas, right ?
Because I have changed my visa because of new job code but with a same employer.
So two things, I was worried about:
1) Do I need to update the visa of my dependents first before applying for an ILR ?
2) How I and my dependents will complete 5 years ? That will enable us to become an eligible for an ILR.
I hope I conveyed my query.

Many thanks for your help if you could guide.

1) No.
2) What do you mean how ? I told you how and when you become eligible. Not sure what you mean here

I really appreciate for your time on this.
Just got confused with the following statement

"A partner or child of a Skilled Worker visa holder needs to apply for a visa update separately, but can do so at the same time as the visa holder or before their current visa expires"

Another confusion was, on the decision letter of my dependents duration is from 23 June 2022 to 14 June 2027. Some days were missing in it that's why bit worried.

I hope you got my point.

Thank you again for your time and guidance.

Kind Regards,
Zeeshan.

Dependants will never be issued a visa that is valid beyond the main applicant's visa expiry. Also, dependants can only apply for ILR after or at the same time as the main visa holder. That is all
