URGENT Change of Employment in Tier 2 from NQF Level 6 to 4?

Post by neil2000 » Sat Apr 05, 2014 1:51 pm

Hi,
I've been in Tier 2 (General) for about 18 months now, on a job that falls under an NQF Level 6 category, paying £45K/year. But, I've been made aware that my job is at risk of redundancy, meaning: I might lose my job in the next few days. I have come across a really good opportunity with Tier 2 Sponsorship, but it is an NQF Level 4 paying only £22K/year. Although I'm happy to take the pay cut and take the new job under NQF level 4 with £22K, my solicitor says my application will be rejected because I'm not allowed to go down from an NQF Level 6 to NQF Level 4. Is that true? Why should I not be allowed to reduce my salary, and NQF levels?

Quick responses are much appreciated as I've to sort this out against the clock. Thanks in advance.

if your initial T2G leave was granted under the rules in place after 14 June 2012 then the new job must be at
NQF level 6.
