Slovak visa - embassy jurisdiction

Post by dsanchez » Sat Jan 19, 2008 4:49 am

Hello everyone

This is my first post, thanks to everyone for so helpful place. Ok here it goes...

My wife is slovak, I am peruvian, we both are living in Peru. We will move to Slovakia and have already made plans for travelling around 18th february. Everything was perfect, all documents in order, and yesterday we called to the slovak embassy in Argentina (which is the slovak embassy for consular matters for Peru and other southamerican countries) and they told us that the consul is not available until 14th february due license (maybe she's on vacations or I don't know). That means that during one month, no-one can apply for a visa for Slovakia in that embassy.

We were shocked because we already made plans and actually there's a job opportunity by that time. So now we're schocked and don't know what to do. So my questions are

1) Do you think it's possible under those circumstances to apply in another slovak embassy?. In southamerica there are just two slovak embassies, one in Argentina and another in Brazil. Do you think is possible to apply in Brazil despite they do not have consular competence over Peru?

2) When we spoke in december with the slovak consul, she told us she would give me a TOURIST visa for three months, which then I could change for the resident permit in Slovakia. Is this OK?. I was expecting a Visa Type" "D" in this case and not a "tourist visa"?

3) In case the Slovak embassy in Brazil does not want to give me a Visa (because of the consular competence), do you think I should try a Schengen tourist visa for 3 months in another EU country embassy in Peru? (and then apply for the residence permit in Slovakia?).

4) In case the Slovak embassy in Brazil grant me the slovak visa, and this visa is from the type "D". This visa would be just for Slovakia or I can ask for all Schengen States (I plan to go to a concert in Paris by march)?

Thanks a lot for your answers!

David.

David.
I've found in the "Schengen handbook" this text which answer to my question 4):

"national visa valid concurrently as a short-stay visa" (type "D + C" visa): this is a national visa issued by a Schengen State (for a long-stay) but which is at the same time valid to travel to other Schengen States for a period of not more than three months from their initial date of validity. Such a visa is issued in accordance with the common conditions and criteria foreseen for issuing uniform short-stay visas. Example: a "D +C" visa issued by France allows not only a stay on the French territory for the whole duration of the visa, but it also allows travelling to all other Schengen States for a maximum period of three months starting from the date of validity indicated on the visa

Can you not apply for a visa in Peru through the embassy of another EU member state, for example Austria or Germany? It is worth checking.

You have a lot of flexibility as a family member of an EU citizen. You can move to Slovenia and work there for a week, and then move to France for work (or study) and then move to ((whereever in the EU)). The only issue is that you need an initial entry visa as you are Peruvian.

Please read about Directive 2004/38/EC through the link below. This is a pretty key Directive for EU citizens and their families

On monday we will call to the Slovak embassy in Brazil to see if they can issue the visa because the non-availability of the slovak consul in Argentina.

In case we get a negative answer we will go to the Austria embassy to ask for a Visa, but do you think they will be able to issue a national type D visa for Slovakia? or they will just be able to issue a Tourist type C visa Schengen? I think this second would be more likely.
