Visa for entering EEA

Post by CAHardwick » Wed Apr 20, 2011 7:40 pm

My partner who is a non-EEA member is the father to our child who is a british citizen, we are not married and my partner has no visas relating to our relationship. He is here on a work permit. Is there a visa that he can apply for other than a Schengen tourist visa to enter Italy by being the dependant of our son?

What is he planning to do in Italy? Move there? Visit for vacation? Business trip?

Do you and your non-EU partner live in the UK? How long have you been together? What citizenship do you have?

We are going on holiday for a week. We both live here, I'm British, he is Colombian. We have been together for 4 years and our son is 4 months old.

Maybe you can explain why you want something other than a Schengen tourist visa?

There are things he could do if he wanted to live there with your son, but without you, but that would likely be more work than applying for a tourist visa.

Have you read through the Italian embassy web site? http://eumovement.wordpress.com/2007/04 ... u-citizen/ explains the general requirements (not Italian specific), assuming you will all be traveling together.

Ok, so the story is this. My partner went to the Italian vias agency yesterday for a visa for us to travel to Italy on holiday. Usually when we travel to Europe he has a Schengen visa, but because we have had a son since our last holiday the agency told us we could apply for a visa through using our son, who is a dependant of my partner. The problem was, i was not at this meeting and could not ask the questions i wanted to. The lady could not tell my partner under what right he could apply for such a visa and she couldn't tell him the name of it. She also told him that she thought that the visa might be multiple entry and if he were to travel again he would be able to do so without my son. This did not ring true to me so I just wanted to see what information I could find out. He applied for this visa because it is free. It would seem that he has got the right to apply for this visa. However, as Colombia is a black listed country it is possible that it might be refused under the grounds of 'National Security'. But he does already have a 5 year visa for the U.S, so that might work in our favour. I doubt that it will be for multiple entry and he most certainly will not be able to travel without our son. With that, I wish that he had just applied for the Schengen visa as he had another trip vaguely planned to Italy later in the summer and will have to apply for another visa later on! Many thanks for your help, if there is anything you can add then please clarify for me. This is a brilliant website that I am sure to use again!

I know of a Colombian who got an Irish visa and a German visa at no cost and based on a simplified application based on the fact that he was going to be traveling with his UK citizen 7 year old.

You will have had to submit the child's UK passport and the child's birth certificate.

But you could equally have done it on the basis of the long term relationship with you.
