I have been granted Tier 1 (General) VISA back in Sep 2008. It is valid from 25-Sep-2008 to 24-Sep-2011. Due to some family commitments followed by paternity reasons when my daughter was born last year (March 2010), I was not able to go to UK for Job opportunities. However my intent is still work in UK as Highly Skilled worker as I see lots of job opening that suits to my profile.
Now since I have only less than 6 months left, before my VISA expires, I want to know that would I be able to apply for Extension to Tier(1) VISA for 2 years. I have used point calculator for Tier 1 VISA and I hold 35 points for Master’s degree in education, 10 points for Age factor(31 years old) and if I see my last 12 months earnings, it is around INR 160000. So using the uplift ratio (As I had this earning by physically working in India), I get around GBP 120469 (Multiplier of 5.3 ). This mean I can earn another 45 points for earnings. Won’t it be true?
So this qualifies me with 90 points, meaning I meet the minimum points requirement. However I am still not sure about if there is any other catch/law, that should prevent me to grant Further Leave to Stay under Tier 1( General) category.
Can you please let me know you assessment and advice to me on above scenario.
