Tier 1 (General) Extension - If not visited to UK

Tier 1 (General) Extension - If not visited to UK

Hello,

I have been granted Tier 1 (General) VISA back in Sep 2008. It is valid from 25-Sep-2008 to 24-Sep-2011. Due to some family commitments followed by paternity reasons when my daughter was born last year (March 2010), I was not able to go to UK for Job opportunities. However my intent is still work in UK as Highly Skilled worker as I see lots of job opening that suits to my profile.

Now since I have only less than 6 months left, before my VISA expires, I want to know that would I be able to apply for Extension to Tier(1) VISA for 2 years. I have used point calculator for Tier 1 VISA and I hold 35 points for Master’s degree in education, 10 points for Age factor(31 years old) and if I see my last 12 months earnings, it is around INR 160000. So using the uplift ratio (As I had this earning by physically working in India), I get around GBP 120469 (Multiplier of 5.3 ). This mean I can earn another 45 points for earnings. Won’t it be true?

So this qualifies me with 90 points, meaning I meet the minimum points requirement. However I am still not sure about if there is any other catch/law, that should prevent me to grant Further Leave to Stay under Tier 1( General) category.

Can you please let me know you assessment and advice to me on above scenario.

No, it's not that easy. You cannot use uplift ratio for extension applications.

Plus I think uplift could only be used once the amount is converted into pounds. You cannot simple multiply your currency by the multiplying factor and assume that they are pounds.

Hi ,

There are few points mate! you have to consider before stepping in UK

1) 6 months to your Visa expiry will cause you trouble in entry point and you have to come up with good reason that why on earth you are in your home country for all these years. This will be pretty tough !! and i am only 15% sure you will pass this point . Wish you Luck!

2) Once , you are here you have to show some earnings and pay some NI & and tax . In your present case , you can't apply uplift ratio . I am 100% sure about it ..

Your case is much difficult as per your extension is related ...

If he tells the truth he is very unlikely to be refused entry. He has a visa valid until that date and can use it up to expiry.

There is no requirement for extension that NI & tax needs to be paid in the UK, unless relevant earnings were made here. If he has no UK earnings, what will he pay tax on?
