OVERSTAY - UK spouse and child bar waiver?

Hi everyone,

I met and married my US husband on a tourist Visa- we didn't have any intention of getting married but did. We conceived our baby and I came back to England to give birth and had overstayed past 180 days but under 1 year on an ESTA Visa (arrived March 8 2019, left March 28 2020).

Now we realized I will be barred for 3 years and are looking for possible workarounds. Does anyone have any ideas or alternatively know any reputable immigration lawyers who may be able to help? Has anyone also dealt with this situation/ could tell me about their resolution?

An ESTA allows you to stay in the US for 90 days. The 180 days is if multiple trips are made in a 12 month period.

Technically, ESTA (Electronic System for Travel Authorization) is not a visa, it is a visa-waiver. ESTA allows eligible citizens to stay in the US for periods of up to 90 days (and no more than 180 days in a year if multiple trips are made).

Unlikely that there are any 'workarounds' or loopholes.
