urgent advice needed urgently

Post by 9jaboy » Sat Jun 09, 2012 3:53 pm

i came into the uk on a visitor's visa but at the point of entry, i was denied entry based on the fact that i didn't have enough funds on me. i was told my visa was cancelled and i had to go back to my country, but as i claimed i had someone in the uk who was ready to sponsor my 2 weeks stay, they took me to a detention center where i got a bail, and was told to go back within the 2 weeks i planned, but when i got to the airport voluntarily, my passport was not provided. Few weeks later, i got a letter asking me to come sign every week until a particular date when i would be interviewed again to see if i could be granted leave to enter or not, this has taken a total of about 5months already, as i have been going to sign weekly. The interview date is less than 2 weeks now. what should i do quickly as i do not want to go back anymore. there is nothing to go back to do at home as i have lost my job already.

So, other than the job that you have lost you have no ties to your country of origin / residence strong enough to make you return?

What ties do you have to the UK, that can be considered when evaluating whether to allow you to remain (if at all possible)?
Life isn't fair, but you can be!

You wife is divorcing you....or your 'wife' is divorcing someone else?
Where are your children, in the UK or in your home country?

this is not a joke, i just heard yesterday morning to expect a divorce paper, i planned on coming here for 2 weeks, now i have spent over 4months and she thinks i am just making stories up to leave her for some white girl so before i do that, she is leaving me and my children are in my country. i am accepting fate now by staying here and trying to bring my children here in future as it is truly better here, no doubt. i do not want to abscond though... i need the best advice pls, pls, pls, i am desperate but do not want to break the law.

If your wife and children are in your home country, what personal ties do you have in the UK? That's apart from wanting to stay because you prefer this country to your own. In other words, what case can you present to convince the Home Office you should be given the right to stay here permanently after entering as a visitor?

this is exactly why i am here, i am not sure how best to present myself other than there is nothing to go back home to. when my dad heard of my detention, he fell sick and had a stroke, right hand and leg, damn... my wife is leaving me and i am not there to pay my first child's school fees, he's been sent away from school. i do not think i have any ties here what so ever... not even a girlfriend... pls advise me more pls... or question me more if necessary... thank you loads.

Because if you had wanted to go home to be with your wife and pay your child's school fees and see you sick father you could have done so at any point in the last 5 months and i have never heard of the ukba taking 5 months to grant leave to enter to a visitor.

So you have no ties in your own country apart from a wife, children and a sick father. Here you have no ties whatsoever.
My best advice would be to return home and take on the responsibilities you appear to be avoiding....although I'm inclined to agree with Greenie and I've probably just wasted my time.
Whether this is a genuine query or not, in no way are the authorities going to take your claim seriously.

If you had requested your passport in order to leave the UK then they would be more than happy to provide it. You have alluded now to being afraid of returning so is this the purpose of your interview in two weeks? Did you claim asylum?

i did not think and i still do not think that claiming asylum is for me... although it has not been explicitly stated to me, i simply understand that my passport has been misplaced.

Is this what they have said? If so why can't you reply for a replacement?
