I'm looking for answers to a very specific issue...

I am a British Citizen by birth, I married a Georgian man here in the UK and through his marriage to me he now has British Citizenship.

We are now separated but not divorced. One year after our separation he traveled back to Georgia and had a religious wedding ceremony with a woman in Georgia (I don't think it is a legal marriage)

He has somehow managed to bring her to the UK - she came in July 2016 for 6 months and then returned to Georgia for 2 weeks. She came back to the UK in January 2017 and has been here ever since.

She became pregnant by my husband 3 months after she came to England (October 2016) so was approximately 3 months pregnant when she left / returned to the UK.

Their child was born in June 2017 and she is still living with my husband here in England. She has also set up her own catering business while she has been here.

Given that my husband and I are still legally married, I am intrigued to know how he has been able to get around what I thought were very strict immigration rules and managed to bring his new 'wife' to the UK, and for her to set up her own business and have a baby using the NHS?

Any thoughts???

Unless you know what visa she is one, presumably she is here as a visitor and therefore not entitled to free NHS at all.

Any chance he processed a divorce without your knowledge, either here or in Georgia?

For her to get an unmarried partner visa, he would have had to provide evidence that he was free to marry.

You could report her to the HO if you wanted but as she now has a British child, she could apply to stay in the UK.

I assume she was able to obtain a visitor visa for the first 6 months (although I don't know on what grounds?)

She must then have gone back to Georgia before her visa expired, stayed for a couple of weeks and got another visa and then returned to England (again I don't know on what grounds and I presume she didn't declare she was pregnant)

Now that she has given birth here in the U.K. and with the father being 'British' will that make it easier for her to remain here?

I find it all very confusing and because of data protection can't get any answers through the official channels, which is why I thought I'd try to see if I could get any answers here!!?

Not sure how she would have managed to get two visitor visas so close to one another as the general rule is a visitor cannot remain in the UK for more than 180 days per 12 month cycle.

Yes, but not an easy road for her either.

You won't get any answers and even if you report him or her, HO certainly won't keep you updated.

My advice would be is to report them with any evidence you have, sort out a divorce and move on. I mean this in the nicest possible way, so please don't take it the wrong way.

CR001 Thanks for your replies...

I forgot to mention that I am trying to find out whether my husband has processed a divorce without my knowledge... it is impossible to get any answers from Georgia and I am in the process of trying to find out here in England - again, data protection is proving a problem (even though it relates to me!!)

I am going to try to move on - it would be nice to have some answers in order to help me do this! My husband is a deceitful man, who doesn't think that the rules apply to him and it is so frustrating to see that he has found a way to get round the immigration rules.

I will be consulting a solicitor with regards to our divorce, but I don't have an endless supply of money to dig further, which is why I thought I'd try and pick the brains of people here to try and get some answers!!!

It is all so frustrating!!!

Finally I found out how they got around it...

She has a UK Residence Card!!

Apparently you can become a UK resident in less than 2 years.... Crazy!!

What a joke that a bigamist can bring his new wife to the UK so easily!!!

There are many different types of residence cards, all with their own rules and requirements that have to be met. So stating this is what the peraon has, doesnt mean much as it massively depends what category it is.

Your sweeping stating of UK resident in less than two years is also not entirely accurate either.
