Time Period of Tier 1 or skilled worker towards ILR

Post by c781 » Wed Jun 14, 2023 10:14 pm

Hi All,

I am not sure if this is the right place to post this. I apologize in advance if I have posted in in the wrong forum.

I am on a tier 1 Entrepreneur visa and I am in the process of applying for extension. However, I was thinking of switching to skilled worker. I came across two different information on continuous period (to apply for ILR) which I really need help from experts share their thoughts on please.

1. Tier 1 Entrepreneur to ILR
https://www.gov.uk/indefinite-leave-to- ... bal-talent
In the above link, it mentions "If you have a Tier 1 (Investor) or Tier 1 (Entrepreneur) visa, you cannot include time you’ve spent on other visas." Does it mean that if I switch to skilled worker, the time I spent on Tier 1 would not count towards ILR and clock will reset?

2. Skilled worker to ILR
Say for example, I manage to switch to skilled worker. In this case, following link says "In the 5 years
you’ve lived in the UK, you can include time you’ve had on any combination of the following visas: any Tier 1 visa - except Tier 1 (Graduate Entrepreneur)".

https://www.gov.uk/indefinite-leave-to- ... sa/time-uk

I am totally confused in both the scenarios. Could someone help to advice on these information please?

Thanks

If you switch to skilled worker, it is the second one that applies to you.

Note that on skilled worker, you cannot continue to run your own business. You are only permitted to work PAYE employee for an employer

Hi CR001,

Thank you for clarifying this as I had a similar query.

Can you please mention the documents which will be required to prove the time spent on T1 entrepreneur visa? I already had my extension in November 2022. Thanks

None required if you are applying based on holding a skilled worker visa.

All information is on the ukvi website and the set o form and guidance.
