A Quick Question Please...

Hi...I am a US citizen and married my UK hubby and my children and I were granted the spouse and dependent visas. We have one child together and one on the way. I have children from a previous marriage.

Since moving here, my hubby applied for child benefit for our son together, and child tax credit for all children as he is our provider. We did the joint application and were approved with funds being paid to him in his account.

My question is simply this...I have a nagging fear when we go to apply for our FLR, we could be denied for him receiving the child tax credits. Based on him receiving them, can we? Or is he entitled to them as a British citizen and I'm worrying for nothing?

Child benefit for all children living with you must be claimed in your husbands name. Child tax or working tax credits must be a joint claim. He is entitle to claim them.

No effect on ILR application in future.

I am wondering what people who claim benefits will write on application appendix which ask if you or your partner receive any benefits. This area is a trick to deny people whose sponsor have the right to claim some benefits. Those who will be extending their stay should check this clause very carefully if you will not extend using all income from benefits. With this trick some people will be denied when they extend their spouse visa. There is no option on the form to tell if is you the sponsor or the sponsored that receive benefits. You tick that you receive benefits it tells you to use the other option...income from benefits. I must state this is not the case for pre july 2012 applicants
