Two jobs and Tier 2 Application...

Post by GondalUK » Thu Jul 23, 2015 5:57 pm

Hi All,

I am applying for Tier 2 VISA next week. I need advice from the expert forum members regarding one important matter.

My MSc was finished in May and according to CAS I was allowed to work fulltime after 30th June which was official end date of my MSc. I got a offer from a company and they were willing to sponsor my Tier 2 VISA and I joined them on 1st July.

I was also working part-time (20 hours per week) during my MSc, they also wanted me to keep working for them part-time. So now I am working for both companies.

Question: According to Tier 2 rules I can do 2nd part-time job in same industry. I have same job as "Senior Software Engineer" for both companies, I work 40 hours in one company (my sponsor) (4 days) and 20 hours (2 days) in another company. Should I continue this routine while process of Tier 2 VISA application or I should stop part-time job temporarily and once I have Tier 2 VISA I should start the 2nd part-time job again?

Please help!

Thanks,
Masood Ahmed

if you are allowed to work full time outside your term time, then during the visa application time, you are covered under the same rules as of your previous leave , i.e. your last student visa. Hence it should be fine working for both employers

Full time = 40 ish hours per week! Working 60 hours a week is quite in excess of that. I would argue that you are allowed to work only the full-time (that is why it is called full time) job after term time until your get your Tier 2.

I dont think the above post makes sense.. are u suggesting that 60 hours is more than full time? who determines what is full time? 40 or 48 or more than that.. mind u some doctors, especially in surgery have to work over 60 hours every week.
i think the OP should be fine as there is only a restrictions of how many hours u cant work more .. like no more than 20 hours.. if the limit doesnt apply, like in this case, than it should be fine.

I agree with iworker. You can work for two companies for the time being. However once you receive your T2 visa you will have to apply to UKVI for your secondary employment. You can find it in UKVI website under what you can and can not do.

When applying for a work visa (Tier 2) full time work is defined as somewhere around 40 hours per week (usually 39 hours). I do agree that many professions do work more hours (including my own). I think working 60 hours per week for two different employers is taking the mick, but the guidance for Tier 4 does not specify the hours of 'full-time' work. It was just my opinion, and yes it does make sense given that the codes of practice and required salaries for Tier 2 are generally defined around a 39 hour week.

On a Tier 4 leave and when "full-time" work is allowed, one may choose to work 24 out of 24 hours per day. His / her choice!
On a Tier 2 leave, a person can work more than the defined minimum full-time hours (37.5 / 39 / 40 / 45) if he/she chooses or if the conditions of employment requires a person to.
Life isn't fair, but you can be!
