CHILD BORN in UK to Tier 2 General Visa Holder

Post by sabikhi » Mon Jan 14, 2019 10:15 pm

Dear Admin,

Immigration History
1. First Entry Dec 2014 on Tier 2 ICT Visa - Self , Wife and 4 Year old son
2. Wife switched to Tier 2 General in June 2016
3. Self and Son switched to Tier 2 General Dependent in Feb 2017
4. Daughter born in UK on 20-Nov-18

Question:-
1. I am filling the form on the link - https://visas-immigration.service.gov.u ... dant-child for child's visa. Is that the right form?
2. The form doesn't ask for the duration of visa and is defaulting to the original visa duration of the wife (i.e. more than 3 years). As the wife has already spent over 2.5 years on T2G, I am keen to apply for a less than 3 years visa as it saves on the visa and NHS surcharge costs. Is there a way to do so?
3. Will the newborn be eligible for ILR alongside mother once her(mother's) 5-year term is over?
4. When will I and son be eligible for ILR?

1. Yes

2. You might get an Ihs refund. You can't change the dates as far as I am aware.

3. Yes but a UK born child does not need ILR if you plan on registering the child as british once either parent has ILR.

4. Once you and son have 5 years on pbs dependent, so 2022.
