T2 General Dependent

Post by Vyshak » Tue Jan 29, 2019 5:29 pm

Dear Experts
Greetings

I am writing to seek your expert advise.
I have a T2 (General) Migrant visa sponsored by my company.
I will be eligible to apply for my ILR this year, how every my wife was absent for more than 180 days in a 12 month period, for 2 years.

Her details of stay is as below.

2015 - in UK for 114 days
2016 - in UK for 137 days
2017 - in UK for 365 days
2018 - in UK for 330 days
2019 - Will be in UK for 365 days.

Question:
1. As she holds the T2 General dependent visa. When we take the extension of her visa, will we be eligible to apply under T2 General dependent...? OR will we have to apply as a ILR dependent..?
2. If its the ILR dependent visa, then will the clock reset to 0 & does she have to complete another 5 years before she applies for her ILR OR can we apply for the ILR after 2 years, by which she would have completed 5 years of being present in the country.

Your expert advise will be much appreciated.

Thank you

Regards
Vyshak

1. If you get ILR based on tier 2 then she can conto ie to extend her tier 2 dependent visa.

2. Yes it will reset to zero and a new 5 year residence route to ILR. She cannot combine time spent on tier 2 dependent with ILR dependent to make up 5 years.
